1. Acceptance of Terms

By accessing, browsing, or uploading your curriculum vitae (CV), professional profile, or employment history onto the Key Connections portal, you agree to be bound by these Terms of Service. If you do not agree to these terms, you must refrain from using this website and our digital platforms.

2. Services Provided

Key Connections operates as a specialized recruitment and talent placement consultancy. Our platform and services allow candidates to submit or verify their professional credentials to be matched against technology, cloud engineering, and data vacancies with our corporate clients. Our services are completely free of charge to candidates.

3. Candidate Obligations, Warranties & Indemnity

By submitting your information, creating a profile, or engaging with our talent consultants, you explicitly warrant and represent that:

All information, employment history, technical skills, and qualifications provided are honest, accurate, and completely true.
You hold the legal right to work within the territories relevant to your application.
Your submission does not infringe upon the intellectual property, privacy, or contractual rights of any third party.
Restraint of Trade & Non-Competes: You warrant that by entering into placement discussions through the Company, you are not breaching any active restraint of trade, non-compete clause, or confidentiality agreement with your current or past employers.
Technical Certifications: You warrant that all stated cloud, software, and technical certifications (including but not limited to AWS, Microsoft, Google, Cisco, or academic degrees) are valid, active, and legally held by you. You hereby grant the Company authorization to verify these credentials directly with issuing authorities or public registries.
Indemnification: You agree to indemnify and hold harmless Key Connections against any claims, losses, reputational damages, or costs (including legal fees on an attorney-and-own-client scale) incurred by the Company as a result of you providing fraudulent, negligent, or intentionally misleading information regarding your qualifications, employment history, or immigration status.

4. Core Processing, De-identification, & Portal Representation

Core Operation: You acknowledge and agree that the core service of the Company involves matching your specialized skills with prospective corporate employers.
Pseudonymized Profiles: In accordance with POPIA Section 11(1)(b), you authorize the Company to format, summarize, and display pseudonymized and de-identified representations of your skills, qualifications, and experience on our secure, restricted-access client portal and within targeted B2B marketing channels.
Regulatory Standard: You acknowledge that while individual direct identifiers (such as your full name, contact information, and specific current employer details) are masked or stripped from initial presentation, the highly specialized nature of your technical profile may allow sophisticated market actors to deduce your identity. Consequently, the Company treats these profiles as pseudonymized personal data under our Privacy Policy, protecting them via secure, individual authenticated corporate logins restricted to verified prospective employers.
Consent to Share: Your unmasked, full CV and identifying contact details will only be shared with corporate clients after our consultants have discussed the specific role with you and obtained your direct consent.

5. Multi-Channel Communications & Automated Sequencing

Communication Channels: By submitting your details, creating a profile, or responding affirmatively to our talent sourcing outreach, you explicitly consent to receiving career opportunities, interview updates, and marketplace insights from the Company via email, automated email sequencing platforms, and direct mobile communications (including WhatsApp and SMS).
Opt-Out & Digital Unsubscribe: You retain the right to opt out of automated communications at any time. Every automated email or WhatsApp sequence dispatched by the Company will feature an accessible "Unsubscribe" or "Stop" functionality. Choosing to opt out of marketing or nurturing sequences will not affect administrative communications regarding an active, ongoing interview loop in which you are an active participant.

6. Right to Represent and Client Introduction Exclusivity

When the Company presents your pseudonymized profile or formal CV to a corporate client, and that client requests an interview or further engagement, you grant the Company the exclusive right to represent you for that specific vacancy and corporate entity. You agree not to submit your application to the same corporate entity directly, through another recruitment agency, or via any third-party intermediary for a period of twelve (12) months from the date of the formal introduction.

7. Limitation of Liability

While the Company applies rigorous professional standards to match candidates with roles, we do not guarantee:

That use of our platform or alignment with our talent network will result in an interview, job offer, or placement.
The accuracy, validity, or long-term financial viability of job postings provided by corporate clients.
The final terms, workplace safety, or conditions of employment offered by third-party employers.
The Company, its employees, and its contractors shall not be liable for any direct, indirect, or consequential loss or damage arising from your use of this website, algorithmic sorting, or any employment placements resulting from it.

8. Acceptable Use & System Integrity

All content, branding, code, text, and layout on this website are the intellectual property of Key Connections. Unauthorized reproduction or distribution is strictly prohibited. You explicitly agree not to use automated bots, scrapers, data-mining tools, or reverse-engineering techniques on this website or candidate portal, nor will you attempt to artificially bypass or manipulate our CV parsing and matching algorithms.

9. Termination of Service

We reserve the right to suspend, purge, or terminate candidate profiles, without notice, if we suspect any fraudulent activity, provision of false credentials, breach of active restraints, or any other material breach of these Terms of Service.

10. Governing Law & ECTA Disclosures

These Terms of Service are governed by and construed in accordance with the laws of the Republic of South Africa. Any disputes arising under these terms shall fall under the exclusive jurisdiction of the South African courts.
